The revision of the EU public procurement framework is timely and particularly relevant for the energy sector. Based on experience with the application of procurement directives, a revision of their scope is recommended, including the possible exclusion of the energy sector, sectoral contracting authorities, and/or specific production sources pursuant to Article 34 of Directive 2014/25.

The current Directive 2014/24/EU requires that only the successful tenderer be published in the contract award notice, through information enabling its identification. EBU would like to echo the concerns and recommendations expressed by its umbrella group the European Disability Forum. The Public Procurement Directive has enormous potential to foster inclusion for persons with disabilities (PWD) but it does not currently reach its full potential. The directive underserves PWD in a number of areas, particularly when it comes to support services.

Achieving more effective and competitive public procurement process in Member States, which contributes to the effective, efficient, and economical use of public funds, is a key priority for the Commission for Protection of Competition.

There is legal uncertainty regarding the grounds for exclusion. We propose that the revision of the rules limit the ‘blocking’ of companies to cases of proven fraud, avoiding discrepancies in the interpretation of solvency documents issued by parent companies outside the EU (due to differences in format or national legislation) resulting in the exclusion of innovative European subsidiaries.

City of Turku welcomes Commissions initiative and emphases that the EU procurement rules should be simplified and administrative burden should be reduced. Contracting authorities should be provided flexibility in carrying out public procurement. It is likewise essential that the regulatory framework enables the integration of environmental and social considerations into procurement processes.

The European Council of Engineers Chambers (ECEC) together with several representative organisations of Architects and Engineers signed the Luxembourg Declaration in May 2025 calling for the following revisions: 1.

For European SMEs, the Public Procurement Act should focus on defining and simplifying the procurement process rather than prescribing what has to be procured. Additionally, the division of contracts into lots is essential to facilitate SME participation. Therefore, the current provision should be strengthened by establishing a mandatory 'divide or explain' mechanism.

The municipality of Trelleborg agrees that EU procurement rules should be simplified and made more accessible, not least for smaller businesses. We welcome the revision of the EU public procurement rules and would like to highlight several issues based on practical experience as a contracting authority. A major and increasing challenge in public procurement is the consistent decline in the number of bidders participating in procedures. Many tenders now receive only one offer or, in some cases, no offers at all.

The Danish Institute for Human Rights welcomes the revision of the public procurement directives. The Institute recommends that any revision ensures: 1. Alignment with international responsible business conduct standards 2. A coherent approach to responsible business conduct in the EU 3. An integrated approach to human rights and environmental objectives in public procurement in the EU 4.

In summary, we welcome the Commissions initiative and emphasise that the revision must meaningfully simplify rules, reduce administrative burden, and provide contracting authorities with greater flexibility. I am a buyer for a school board with 40 schools. I would like to raise the following concerns with regard to Directive 2014/24 EU: — Could there be more focus on smaller procurers with a private legal form? European Commissions Public Consultation on EU Public Procurement Directives feedback from Virke the Federation of Norwegian entreprise Virke, representing approximately 25,000 businesses and more than 300,000 employees in the trade and service sectors, notes the Commissions intention to revise the EU Public Procurement Directives.

Vewin, the Association of Dutch Drinking Water Companies, represents the collective interests of the public water utilities responsible for delivering safe and reliable drinking water across the Netherlands. As stewards of an essential public service, Dutch drinking water companies operate within a framework that prioritizes public health, sustainability, and long-term resilience.

In accordance with Directive 2014/24/EU, the contracting authorities need to actually move from a price-only award model to a best value for money approach for commercial cleaning services. Cleaning services are labour-intensive and quality-critical, with service outcomes directly affecting health, safety, sustainability, and operational continuity.

Article 57 (5) of Directive 2014/25/EU: The current directives on public procurement provide that a joint entity, set up by different Member States, applies either: a) the national procurement provisions of the Member State where the joint entity has its registered office, or b) the national procurement provisions of the Member State where the joint entity is carrying out its activities.

With regard to the inclusion of social return requirements in a call for tenders or procurement procedures, I suggest that the requirement that this be achieved within the contract should be waived. People with vulnerable labour market positions benefit from appropriate work related to their qualities and capacities.

It is deeply shocking that the “for a europe in the world” fund subsidises infrastructure projects in the form of grants, which are then built by companies from outside the EU such as China or Türkiye. This is largely the case in the Balkans per example.
