The Austrian Bar Association (ÖRAK) welcomes the planned revision of the EU public procurement directives. The main problem for users is already the complexity of the existing rules and the opacity of the current rules. In particular because there are more and more rules which, outside the procurement directives, also have an impact on public procurement.

It should be noted at the outset that the current Directive and its implementation in AT have in principle achieved their objectives. On the part of contracting authorities, the extensive publication and reporting obligations are perceived as negative, as they are a significant burden. In particular, there are recurrent questions about what happens with the data collected and what conclusions can be drawn from it.

The Bar has made considerable efforts in recent years to make the fight against money laundering and terrorist financing even more effective. The ÖRAK (Austrian Bar) notices that “central EU mechanisms/bodies to strengthen the preventive framework” are deemed to be an option for future EU measures.
