However, the current requirements do not comply with this, as they are too closely aligned with the public procurement law of the contracting authorities. In general, the procurement of energy (i.e. also gas, oil and consumables) should be exempt from public procurement law.

From the point of view of commercial airports, commercial airports, as operators of critical infrastructure, are at the same time competitive undertakings. EU public procurement law, in its current form, often fails to fulfil this particular role and leads to considerable competition, efficiency and a lack of flexibility.

The German Airports Association (ADV) welcomes DG MOVEs initiative for a new European aviation strategy. The strategy should create a binding framework that strengthens the competitiveness, resilience and sustainability of European aviation.
The German Airports Association (ADV) is opposed to a tightening of the European legal framework for airport charges (ACD) and ground handling services (GHD). Extensive regulatory requirements are not appropriate against the background of the current market conditions and competitive environment.
In the light of current developments in the air transport market, airports need planning certainty beyond 2027. The ADV airport association therefore supports the Commission’s plan to amend the Guidelines on State aid to airports and airlines (Air Transport Guidelines). This concerns both operating aid and investment aid. Our detailed opinion can be found in the attached document.
