I would like to thank the European Commission for the opportunity to respond to the call for evidence for an impact assessment on Intellectual Property – new framework for standard essential patents (SEPs). Standards provided under FRAND-terms may cause significant obstacles for organisations which seek to implement such standards in software (EC, 2012; Lundell et al., 2015, 2018, 2019, 2022).
