EU consultation

Revision of EU rules on food contact materials

222 submissions from 201 organizations told the European Commission what they think about this file. Here is what each of them said, in their own words.

The Commission lists 912 submissions on this file. Shown here: the 222 from organizations. Not shown, by design: submissions from private individuals, which we never publish, and anything filed since our last weekly refresh.

Who showed up

169 submissions from industry — companies and their trade associations — against 25 from civil society: NGOs, consumer organizations, environmental groups and trade unions. That is 6.8 industry submissions for every one from civil society.

Industry 169Civil society 25Public authorities, academia, other 28

Groupings use the respondent type each organization selected when filing. Counting submissions, not organizations — a body that filed twice is counted twice.

We, professionals, use wood species that have historically been for food contact, e.g. oak barrels. Food finishes are applied for containers containing hot or cold liquids. Global migration is already referenced for these products. Your study or survey is null and void. Our art professions need your support and do not call into question varacular uses or solutions of 30 years’ experience.

As a small professional company, I am a artist who works alone, it is in fact totally inappropriate to require our art workshops whose activity, by definition, is part of an artistic creative approach which gives each room a unique character, carried out in single pieces or in small series, to carry out destructive tests of samples per batch.

I am a wooden rotating artist and make unique parts that serve as a receptacle for food (plates, bols, saladiers, etc.). Some of my coins are unique and the new legislation simply makes my activity out of the law! It has long been known that some wood is completely harmless to health. Why not adapt legislation to small craftsmen who are responsible for artistic work and actors in a local and healthy economy.

Since 2008, as a professional artist based in an individual company, I have combined various ancient ceramic techniques, revisited in a contemporary creative approach. My work is as much the result of traditional know-how acquired during ever more training, as well as constant research to deepen my technique and expression.

I am a Ceramist, I work alone in my workshop and I am a “very” small business. But every day I bring my stone to the building! Forcing me to do these tests is not realistic to the extent that handicraft parts do not lend themselves and I would be obliged to abandon my crockery production!!!!! And this is not the cost of such tests.

We welcome the Commission’s commitment to revise the food contact material (FCM) legislation, and the development of harmonized rules for all FMC. We would like to use the opportunity to address a loophole in the FMC legislation for the dual-use-additives (DUA). In the plastic regulation (regulation EU nr 10/2011), the specific migration limit (SML) is missing as Article 11 number 2 is “empty”.

SMEunited, the association of Crafts and SMEs in Europe, welcomes the revision of EU rules on food contact materials (FCMs) and calls for harmonised rules at EU level that are practical and manageable for Crafts and SMEs. As set out in the various reports supporting the ongoing evaluation of the FCM legislation, the current regulatory framework is complex and challenging for small businesses.

Method. Every quote is verbatim from the organization’s own submission to the European Commission, trimmed to its opening passage and never summarized by a model. Where a submission was filed in another EU language we show the English text the European Commission publishes alongside it, labeled on the quote; the original is one click away at the source. Groupings use the respondent type the organization itself selected when filing. We deliberately do not label anyone “supportive” or “opposed” — you read what they wrote and draw your own conclusion. Organizations only, never individuals. Reused under Commission Decision 2011/833/EU; the European Commission is not liable for this reuse.
