The proposed classification of Titanium dioxide TiO2 as a carcinogen category 2 by inhalation is solely linked to a general particle effect and not specifically to the substance itself. This “dust-effect” applies to many other substances in powder form: Poorly soluble particles with low toxicity (PSLTs). TiO2 has been used for decades in countless products and articles, safely bound in a matrix.

SSAB welcomes the proposed carcinogen category 1B GCL 0.1% for cobalt metal as the majority of the iron ores mined within the European Union contain approximately up to 0.03 % cobalt metal by weight after reduction in the iron ore melting process, thus meaning all steel based upon those iron ores would have contained cobalt in excess of the RAC proposed SCL 0.01%.

The Cobalt, except for very specific alloys, is a component that enters steel in an inadvertent mode, both in virgin raw materials, and in recycled origin, making it extremely difficult to separate the nickel due to its chemical affinity. In stainless steel content up to 0.3 % by weight of cobalt metal is frequent and next to it remains after the recycling process in the electric furnaces.

Colorcon strongly recommends that the adoption of the 14th ATP of the CLP continue as scheduled without TiO2 while the open regulatory and legal questions are clarified to allow full consideration of alternative regulatory options for all PSLTs. Titanium dioxide has been used in industry for decades and there has been no evidence so far of any negative health effects for users. This is not least because when using the dust exposure at the workplace and not the material properties of the titanium dioxide play the decisive role. This is borne out by the fact that effective dust levels are already in place in most Member States.

At this time, the criteria applied to mixtures containing TiO2 require further development and there are still several important issues and implications that need to be considered further, both at technical and legislative level.
