The HDE sees a continued strong need to minimise the disproportionate and unclear rules on sustainability reporting. The ESRS revision offers an opportunity to effectively and sustainably relieve companies of bureaucratic requirements. This opportunity must now be seized. From the point of view of businesses, there is a need for a clear start-up signal and consistent steps to strengthen the business location.

The HDE welcomes the Commission’s balanced Inception Impact Assessment, which explicitly takes into account the interests of the economic operators concerned, in particular SMEs, and compares the potential burden of regulation with its benefits. The explicit focus on legislative coherence and consistency in the areas of liability, product safety and fundamental rights protection is also positive.

1 General The HDE rejects the classification of titanium dioxide as a hazard if there is a suspicion of a carcinogenic effect. Harmonised classification is not appropriate. However, this would create significant burdens and disadvantages for the economy and consumers, which are not justified.

The German Trade Association (HDE) thanked you for the opportunity to comment on the EU initiative for a Digital Services Act. German and European platforms are in international competition. Laws on taxation, customs and product safety, environment, packaging and waste cannot be enforced on non-EU operators to the same extent as on European suppliers and therefore enjoy significant competitive advantages.

The German retail sector suffers from sharply increased costs due to high energy and procurement prices on the one hand, and weak private consumption on the other hand. As a result of the tense economic situation, the HDE expects that around 9,000 shops in Germany will have to close their doors in 2023.

We support the Commission’s objective of promoting a more sustainable economy and conscious consumption. However, we consider the existing consumer law instruments to be absolutely sufficient for this purpose and do not see any need for a new adaptation of EU consumer law. Many of the regulatory ideas raised would have a far-reaching impact on the day-to-day business of the trading companies concerned.
