From an initial analysis, the document does not contain any significant criticism. However, with regard to national application and the other unfair practices recognised by the various Member States when implementing the Directive, combating such practices at transnational level by using the sole instrument of requesting information may lead to a reduction in supranational law enforcement.

AIM, the European Brands Association, welcomes and supports the European Commissions proposed Regulation to enhance cross-border enforcement against unfair trading practices (UTPs) in the EU. This initiative marks a significant step towards ensuring greater fairness and transparency in the consumer goods supply chain.
Agricultural cooperation is the representation of agricultural cooperatives in France. For the record, in France, agricultural cooperatives collect around 70 % of agricultural production and 3 out of 4 farmers join at least one of the 11400 cooperatives using agricultural equipment and 2100 agricultural cooperatives. The FNSEA supports the initiative to improve cooperation between national authorities responsible for implementing Directive (EU) 2019/633 on unfair trading practices in the agricultural and food supply chain. This Directive marked a step forward by recognising the existence of a structural imbalance between agricultural producers and buyers in trade negotiations.

Fairtrade Poland welcomes the European Commissions efforts to regulate the conditions under which terms such as fair or equitable and their equivalents may be used, thereby avoiding misleading claims. Oxfam welcomes the European Commissions 2024 proposal to strengthen cross-border cooperation among enforcement authorities in the implementation of the Unfair Trading Practices (UTP) Directive. This initiative is a positive step toward improving enforcement and protecting farmers against UTPs.
CEJA welcomes the regulation proposal on cooperation among the enforcement authorities responsible for the enforcement of the UTP Directive published by the European Commission on 10 December 2024 and the opportunity to provide feedback on the draft act.
Independent Retail Europe takes note of the proposal and concludes after thorough examination that further clarification of certain legal provisions is needed to ensure the Regulation does not risk undermining the European single market.

The Rurale Coordination (CR) thanks the European Commission for its proposal for a Regulation to strengthen cooperation in enforcing the rules on unfair trading practices (UTP) in the agri-food supply chain. The BoA welcomes the developments brought about by the Regulation, but considers that this first interesting step should not be the only one in the reflection on TPUs.

The FTAO welcomes the European Commissions proposal to boost cross-border enforcement of the EU Directive on unfair trading practices in the agricultural and food supply chain via a regulation that shall complement the Directive in question. However, the FTAO is dismayed to see that a measure established to facilitate cross-border complaints makes no reference to complaints from suppliers outside the EU.
Spain is a pioneer in this type of regulation to regulate Unfair Commercial Practices in the market and to ensure that it functions better. The aim of this regulation is to avoid the abuse of some companies over others, especially those of agricultural and livestock producers, in commercial relations through its pioneering food chain law, amended in 2021.

More detailed regulation of products particularly vulnerable to unfair practices is needed. Honey is an example of such a product. A list of such products should be drawn up, which would benefit from increased attention. The scale of unfair practices concerning honey is very high in many countries of the European Union. The quantity of good product that ends up in the final consumer is too small.

The EU Commission tabled proposals on Unfair trading practices (UTP) at the end of 2024. However, they do not change the substance of the UTP Directive but refer to cooperation between Member States when it comes to cross-border unfair activities. It is, of course, important for Member State authorities to be well-placed to investigate and issue sanctions in cases of unfair trading practices.
