SMEs in the food trade, which offer only regional products from Austria, face major challenges in public tenders. In most cases, the high requirements can only be met by international wholesalers, while small businesses often lack the necessary resources. Targeted promotion of regional food in public procurement would not only facilitate access for SMEs, but also strengthen the regional economy.

One of the key principles of the creative industries is to prioritize quality over the lowest price for services. The current European Directive reflects this goal in various ways, with terms like "quality" and "sustainability" prominently featured throughout the Directive.

Insights and feedback from our members and companies show that especially SME and mid-caps from the EU still face considerable hurdles and obstacles (due to the overall complexity of the process) when participating public procurement imitatives. Overall, the process of participation of SME & mid-caps should be analyzed and simplified.

From both a socioeconomic and security standpoint, its astonishing that European and EU public institutions are allowed to support non-European industrial players by awarding them public contracts. From a sustainability perspective, this isnt just irresponsible its unacceptable. Europe must take a firm stand and demand full reciprocity in public procurement. Anything less is a risk we cant afford.

We forward our proposals to supplement Directive 2014/25/EU of the European Parliament and of the Council of 26 February 2014 (hereinafter also Directive 2014/25/EU). The proposals aim to simplify the activities of contracting authorities in areas where there is no cross-border interest and to enable horizontal cooperation between contracting authorities also in the utilities sector.

Article 27 Open procedure Long mandatory time limits for the submission of tenders, particularly in contracts for supplies and services of a generally available nature for which quality standards are set, so-called shelves products. Our feedback on Directive 2014/24/EU The economic developments in recent years are putting increasing pressure on procurement accompanying departments. We propose to increase the thresholds. The cost increases combined with the limited increase in EU procurement thresholds mean that more and more contracts have to be procured at European level. In 2014, the EU threshold was EUR 207,000.

Proposal for addition of a new paragraph 4 to Article 9 of the new revised Directive 2014/24/EU of the European Parliament and of the Council of 26 February 2014 on public procurement to Article 9 which reads: this Directive shall not apply to postal services provided by the designated operator in international traffic.

The EU claims it wants to promote SMEs but most of the selection criteria are set for large companies. This leads to an ever growing concentration of companies and reduction of number of bidders, reducing the competition and creating a high dependency of the EU on a more and more limited number of companies.

In practice, however, complex public procurement law is perceived as a challenge, as small and medium-sized enterprises or start-ups in particular do not have staff with procurement expertise, given their structure.

In the case of public works in particular, planning services regularly account for between 20 % and 25 % of the cost of works contracts. As a result, this threshold would have to be around 1.3 million instead of 0.221 million (the threshold for construction works is currently 5.538.000).

Negotiation on public procurement. I think it is necessary to allow public buyers to negotiate, regardless of the procurement procedure, including for tenders. EU procurement directives require social requirements in procurement to be linked to the subject of the contract. This is seen as a shortcoming that prevents the assessment of suppliers' use of some aspects of social policy that are longer term or have a greater impact.

— When calculating the estimated value of the contract, it is often difficult to determine which services must be aggregated and therefore to be awarded uniformly (functional approach). The relevant provisions (in particular: Article 5(1) to (4) of Directive 2014/24/EU) should include practical approaches to this grey area.

With regard to Article 62 (1) and (2) of Directive 2014/24/EU in Romania, the requirement for certificates issued by accredited bodies recognised in the Member States is not complied with as provided for in the 2 aligned provisions of Article 62. An example: a Luxembourg company often cannot submit a tender to a French market because the form requires the completion of a SIRET number to validate the submission, which it necessarily does not have at its disposal. I am founder of an agency that does XR projects for institutions and corporations. For this, we also look into tenders in Europe. Sadly, most tenders are just impossible to bid on, as they are provided only in the local language. We do not have the resources nor the capacity to bid on tenders written in for example Greek. We made the enclosed submission to Ireland's Office of Government Procurement with the aim of making procurement more user friendly for both buyers and economic operators. The key policy and process recommendations could be taken into account in the re-design of the EU Public Contracts Directive.

Public procurement procedures are quite successful but could be improved from a practical and economic point of view. Notices of public calls for competition and notices of award are complex to fill in, illegible (redundant information), and crucial information is not highlighted. In such cases, it is mandatory to indicate which items do not have any added value for the purchaser or for the applicant.

SMEunited has supported and welcomed the 2024 Directives as important step to improve participation of SMEs. However, delays and insufficient implementation of the Directive in national law did not lead to the expected improvements.

In order to reduce the administrative burden on contracting authorities, the thresholds increase to double or triple. It takes approximately 15 days for a procurement organisation to prepare a simple EU tender. In addition, more colleagues are involved internally. If the purchase is about 60k per year * duration of 4 years, this is not proportionate. It gives the feeling that the work does not make sense.

The survey asks for comments on the success achieving the goals set out for the three EU directives. However, they exist in a context where also the Implementing regulation (EU) 2019/1780 and 2022/2303 on establishing standard forms for the publication of notices in the field of public procurement form part. I would like to see the application of sustainability requirements and wishes in public procurement mandatory and enshrined in the Aanbestedingswet. The town of Flensburg, as a municipality, has a major problem with Directive 2014/24/EU. Much-needed construction projects, particularly in schools and day-care centres, are severely hampered by the requirements of the Directive. There should be a clear possibillity to perform an electronic dialouge within specific procurements within DPS. 2.

Hello, I have 2 alternative proposals for simplifying and optimising public procurement: 1/a minimum to open the procedure with negotiation: conducting a restricted procedure unnecessarily increases the time taken to implement this procedure. 2/a maxima, authorise negotiation by invitation to tender. In this way, the greater the need for multiple types of procedures, simplification and accountability for all buyers!

Dear Sir/Madam, I have the following comment in support of the Public Procurement Directive: I am a manager of a municipal company and I have already carried out numerous EU-wide calls for tenders in my area of responsibility, mainly planning and (disposal) services. My experience is that candidates outside the country almost never apply (< 1 %).
