Construction and infrastructure are key sectors of the European economy, and the materials used and procured by public authorities should indeed drive demand for sustainable products based on sound, transparent, and indisputable criteria.

The data support the need to continue promoting the presence of SMEs in public procurement processes, especially in countries such as Spain. According to data from the European Commission’s Single Market and Competitiveness Scoreboard on access to public procurement, in 2023, 66 % of tenders in the EU came from SMEs and SMEs were awarded in 58 % of cases; figures in Spain are 57 % for tenders and 53 % for awards.

Our submission focuses specifically on Article 20 of the EU Procurement Directive 2014/24/EU. Article 20 allows public procurers to reserve contracts to encourage the employment of people with disabilities & disadvantage. Member States as the largest purchasers of goods and services should consider how social needs are also met by public spending.

The directives have become too broad and detailed regulation. Tendering is too cumbersome and reduces competition and opportunities for small and medium-sized operators to participate in public tenders. There is also a high risk that they will have their tender rejected due to minor errors and mistakes, even when these do not affect the commercial content of the tender.

The European Social Network (ESN) is a European platform with over 180 member organisations from 34 countries. Our members represent public social services authorities at national, regional, and local levels. The members of ESN, notably social services departments at national, regional, and local authorities, procure social services to ensure peoples access to social care and support.

The current European public procurement framework, conceived at a time when global warming and regional resilience did not yet appear to be vital issues, is today incomplete and sometimes unsuited to the enormous challenges facing Europe. As far as the Public Procurement Directive and the Concessions Directive are concerned, ENGIE considers that they are still relevant today, and that they are still generally adapted to the specific needs of our business sectors. The current rules for awarding concession contracts for instance are satisfactory for the implementation and development of the energy projects we bid on.

While the EU has largely opened up its public procurement markets to companies from third countries, many of these countries do not grant European companies comparable access or are all too often excluded from these foreign markets.

Public procurement should align with Europe's climate, security, and competitiveness goals by integrating sustainability and resilience criteria across all projects. Updating the Public Procurement Directive and enforcing clear environmental standards will drive the adoption of low-carbon solutions.

Public procurement accounts for 14% of the EUs GDP, representing 2 trillion annually. However, it remains underutilised as a tool to drive social and environmental progress. Social enterprises, SMEs, and start-ups face significant barriers in accessing procurement opportunities due to complex financing structures, a lack of public support, and inconsistencies in procurement policies across Member States.

FEAD, the European Waste Management Association, representing the private waste and resource management industry across Europe, welcomes the evaluation of the public procurement directives in the EU. With the aim of improving competition and the circular economy, we present a number of critical remarks on the functioning of public procurement in the waste management market.

Article 12 Public Procurement Directive (PPD) is a significant obstacle to the digital sovereignty of the EU and its member states. The regulation stipulates that public authorities may only exchange services without tendering requirements in exceptional cases. However, the free exchange of services among public authorities is a fundamental prerequisite for administrative cooperation in the field of digitalization.

Eurelectric welcomes the evaluation and upcoming review of the existing Public Procurement Directives. The review can, if designed appropriately, be useful to support the electricity sector in enabling the energy transition.

Optional grounds for exclusion concerning Paragraph 124(1)(7) of the GWB/Article 57(4)(g) of Directive 2014/24/EU. There is an optional ground for exclusion for corresponding unfavourable services. This exclusion is too restrictive in its application. In particular, continued unfavourable performance should also be sufficient.

Public procurement law is far too complex for municipalities with 5000 inhabitants, too expensive and takes too much time. It is an expression of over-bureaucracy and contributes to economic decline! In our statement, we focus on the Directive on Public Procurement (2024/24/EU), assessing it considering the specific requirements of the pharmaceutical industry. As public-law entities, statutory health insurance funds are subject to EU public procurement law.

With regard to the classical directive, I would like to highlight the following points: 1. Increase the quota thresholds. Despite the increase in market prices, they have remained at the same level for many years. 2. Shorten the deadlines for submitting tenders and proposals. Now that public procurement is electronic, such long deadlines no longer seem justified. 3.

The mioty Alliance would like to stress the importance of equal treatment and non-discrimination in the procurement process. In the attached document we use the Low Power Wide Area Network (LPWAN) market in the IoT space as an example of the current situation and what we think needs to be addressed in the Public Procurement Directive.
