73 submissions from 65 organizations told the European Commission what they think about this file. Here is what each of them said, in their own words.
The Commission received 86 submissions on this file. Shown here: the 73 from organizations. Also not shown: 13 further submissions we do not publish for other reasons: no quotable text (a comment under 250 characters and no readable paper), no organization named, or a private person who filed under their own name. About this data →
Who showed up
45 submissions from industry (companies and their trade associations) against 14 from civil society: NGOs, consumer organizations, environmental groups and trade unions. That is 3.2 industry submissions for every one from civil society.
Groupings use the respondent type each organization selected when filing. Counting submissions, not organizations: a body that filed twice is counted twice. An identical text filed by several organizations counts once: 1 submission here repeats one text word for word and is folded into it.

The ZDH welcomes the idea of a European legal framework for protecting SMEs from unfair trading practices. There is an urgent need to strengthen the bargaining power of crafts and craft firms vis-à-vis retailers, so that craft businesses can continue to compete on fair terms. However, the scope of the proposed Directive is too narrow and should be extended.

From the point of view of the German food industry, the Commission takes into account the issue of UTPs in business-to-business relations between companies in the food supply chain. Procurement volumes, overall sales area, number of sites and presence in the marketing and a wide range of sales and trade marks in all price segments have led to a dominance of the four leading food retailers in Germany.

Poland sees the importance of producers and downstream partners cooperation at every stage of the food supply chain. Poland supports these processes. A properly functioning food supply chain in the EU is central to ensuring that EU farmers receive a fair share of the final consumer price and an income comparable with other sectors. Farmers have consistently lost out – in particular due to the concentration of market power upstream and downstream and an unequal bargaining position among the various parties along the food supply chain.
The dairy sector, the milk farmers and their milk processing dairies, are in a unique and specific situation. The specificities of the dairy sector at milk supply level have proven to be essential for the dairy sector and must be respected when considering setting up new horizontal rules.

Significant imbalances in bargaining power exist among the partners in the food supply chain. Such imbalances stimulate certain activities on the part of the stronger party within the business relationship. The problem of UTP’s has been noticed by all stakeholders involved in the food supply chain and particularly by suppliers. Various surveys show that UTPs occur relatively frequently.
