Designs are a fundamental intellectual property right for the LVMH Group Houses and the applicable legal framework is a major topic for the Group.

Unifab is the French association for the promotion and protection of intellectual property rights (IPRs). Today, Unifab represents more than 200 French and International companies as well as professional federations and serves as a unique guardian of its members IP rights by presenting itself as a platform for discussion on these topics.
We at Scania CV AB oppose to the EU Commission's proposed revision of the Directive on the legal protection of designs and the Regulation on the Community design. Design protection should give the automotive industry the same opportunity to prevent the sale of competing spare parts of lower quality and with lower product safety, just like other companies.
Summary of the SEPAF opinion supports the proposals as a whole. Welcomes the fact that uniform regulation is put in place in the Member States and many of the changes proposed are long awaited and expected; New definitions will better clarify the boundaries of the law and modernise its content to better stand up to technological progress.

A design proposal based on out-of-date assumptions The review of the EUs rules on industrial design was widely welcomed when it was first announced in the Intellectual Property Action Plan. However, now that the proposals have been presented, they seem to be based on old, out-of-date assumptions.

However, not all revisions and additions contribute to clearer and simpler rules for SMEs, e.g. limiting design strictly to visible components or delegating power in delicate matters such as appeal proceedings.

AAM (Association of Mutual Insurers in France) represents 31 mutual insurance groups i.e. 91 companies. Key figures from AAM members in 2021: - 47.2 million members and clients, - 102,000 employees, - 46.2% French market share in property damage AAM supports the revision of the Directive on the legal protection of designs.
NOTES 1. Definitions The addition, in Article 3(1), of the words “including movement, passage or animation of these features in any other form” entails the need for implementing rules allowing for a clear and unambiguous representation of such new designs and in the design application and in the register. We request that such provisions be issued after the adoption of Regulation 2.

The IP Federation welcomes the opportunity to provide feedback to the European Commissions proposal for a regulation (the Proposal) amending Council Regulation (EC) No 6/2002 on Community designs and repealing Commission Regulation (EC) No 2246/2002.
The Asociación para la Defensa de la Marca (ANDEMA) is the association that defends companies’ trade mark rights in Spain. This work has been carried out by raising public awareness of the positive impact of brands and the harm caused by the consumption of counterfeits, as well as working together with the main institutions and associations, not only at national but also at European and international level.

Because of the very tight timeframe given, these observations are limited to what our committee considered the most urgent and important issues to be dealt with. On the one hand, under the present interpretation of the Regulation (and therefore of the Directive), the Design law in the EU is unsatisfactory.

We hereby submit our Comments on the Proposal for a Regulation of the European Parliament and of the Council amending Council Regulation (EC) No. 6/2002 on Community designs and repealing Commission Regulation (EC) No. 2246/2002 with special reference to 3D printing for your kind consideration.
We hereby submit the Comments of the GRUR Committee for Design Law on the European Commissions Proposal for a Regulation amending the Community Designs Regulation [COM(2022)666] and a Proposal for a Directive on the legal protection of designs [COM(2022)667] with annexes, for your kind consideration.
I recommend that both the German version of the new regulation and the English version refer to the EU design. From a linguistic point of view, since the introduction of the German Design Act, there is no longer any reference to ‘designs’ in Germany. I therefore recommend a linguistic adaptation to the effect that in future the term ‘EU design’ will be referred to as ‘EU design’ and not to ‘EU design’.
