This implementing act shall be adopted in accordance with the legal obligation of the Commission set out in Article 30f(5) of Directive 2003/87/EC. It lays down detailed rules to provide financial compensation to final consumers of fuels who have to bear the carbon costs of ETS2 in cases where double counting or involuntary coverage could not be avoided.

The Malta Sociological Association (MSA) notes the European Commission's initiative on financial compensation under the EU Emissions Trading System for buildings, road transport and additional sectors (ETS2), recognising its importance in supporting a fair and socially just transition to climate neutrality.
ETS2 is an important component of the EU climate framework, extending carbon pricing to fuel use in buildings is crucial to enable the decarbonisation of the heating and cooling sector. Its effective implementation will depend on clear and workable rules that avoid unintended double counting or unintended coverage and provide a reliable remedy where this nevertheless occurs.
The European Commission’s Public Consultation on the EU Emissions Trading System (ETS2) Financial Offsetting provides an important opportunity to gather input on the implementation of this instrument and its impacts on the different territories of the Union.

Glasshouse horticulture The Netherlands welcomes the Commission’s proposal to enable financial compensation of ETS 2 costs for end users. This is important to avoid that ETS-2 leads to unintended costs for entrepreneurs that are in principle outside ETS-2. The proposed framework provides an important basis for Member States to address those financial consequences of ETS-2 in a proportionate manner.
