Digitalisation of cross-border judicial cooperation (amendment of certain directives and framework decisions)

Fair Trials welcomes the search for ways to make criminal justice systems more accessible through digitalisation. We believe that digitalisation presents a real opportunity not only to promote cooperation between law enforcement agencies but also to better implement existing EU standards on defence rights in cross-border proceedings.

I am against the expansion of digital, against the management of my social life digitally, against digital control. I am not a robot and digital is dehumanisation. I am against digital control, vaccination social pass or not.

The Council of the Notariats of the European Union (CNUE) is the European umbrella organisation representing 22 national Notary Chambers and more than 45,000 notaries. The CNUE is following with great interest the preparative work and the publication on 1 December 2021 of the European Commission 2021/0394 (COD) proposal for an “e-Justice Regulation” on the digitalisation of cross-border judicial cooperation.

A distinction should be made between transferring papers electronically and genuine digitization (which often requires modification of processes). This is also noted in the document 'Digitalisation of justice in the European Union - A toolbox of opportunities'. A conscious decision should be made on which one EU strives for.

The Council of the Notariats of the European Union (CNUE) has taken due note of the publication of the Communication on Digitalisation of Justice in the European Union by the European Commission on 2 December 2020 and, more recently, of the Inception Impact Assessment on digitalisation of cross-border judicial cooperation.

The European Disability Forum (EDF), umbrella organisation defending the rights of over 100 million persons with disabilities in the EU, welcomes the initiatives of the European Commission to improve access and efficiency of the justice system.

Latvia has assessed the distributed roadmap of the initial impact assessment on “Digitalisation of judicial cooperation” and agrees that the introduction of a uniform legal framework in the EU in the field of digitalisation of cross-border judicial cooperation would ensure faster and more effective judicial cooperation between Member States.

Cross border cases is an almost every day work in notary offices. Gathering all the necessary documents in digital form will be a great help, to send and receive digital signed documents will save a lot of time and money.
