The European Social Partners in the telecom sector, UNI Europa ICTS and Connect Europe, have adopted a joint statement on the Digital Networks Act (see attached). Europes technological sovereignty depends on innovative, resilient, secure and high-quality connectivity networks and services as the backbone and the only European-owned layer of the European digital ecosystem.

The EU's planned '28th regime' is Bolkestein revisited In 2004, Frits Bolkestein a Dutch liberal politician and EU commissioner for the internal market introduced a controversial piece of legislation that would forever carry his name. The Bolkestein Directive would allow companies to provide services in other EU countries under the labour conditions of their home country.

The regulation fails to address the crucial role that social partners and collective bargaining play in the deployment of new technologies at the workplace. Participation of workers’ representatives in the development, implementation and governance of AI systems at the workplace is key to ensure the best protection of workers’ rights. Collective bargaining is an essential tool to address technological change.

UNI Europa, the European Services Workers Union and EU sectoral social partner, welcomes this initiative. This is joined by UNI Global Union, the global trade union federation for the skills and services sectors. This feedback responds to the proposal of a due diligence duty. RECOGNISE THE WORKER DIMENSION Throughout the Digital Services Act (DSA) documents there is mention of consumers, sellers, and intermediaries, but no mention of platform workers. Platform workers are just as much a part of this equation. As the DSA address the obligations and responsibilities of platforms, it is therefore necessary to add the employer responsibilities and employment relationship.

There is an urgent need to create fair competitive conditions in the platform industry.
