The braking test is sometimes run in the laden condition at a test station, otherwise the vehicle will be difficult to perform the brake test. If this vehicle is subsequently checked under the road and subjected to a brake test empty, this gives an incorrect picture. The vehicle can then be rejected without any technical defect. A fine is unduly imposed in this case.
