In the WVMetalle’s view, the considerable tightening of the fallback benchmarks provided for in the draft leads to a massive increase in the risk of carbon leakage. The envisaged reduction of up to 50 % would de facto lead to a drastic reduction in the free allocation of emission allowances and would threaten the very existence of a number of companies in the non-ferrous metals industry.

The WVMetalle commented on a number of points mentioned in the Inception Impact Assessment on the revision of the ETS Directive. Linear reduction factor (LRF): According to the Commission, the LRF, which will increase from today’s 1,74 to 2,2 in 2021, needs to be further increased as the EU is expected to agree on a 2030 climate target of 55 % instead of 40 %.

WVMetalle welcomes the possibility of giving feedback to the Net-Zero Industry Act (NZIA) published in March 2023 by the EU Commission. In conjunction with the Critical Raw Material Act (CRMA), this proposal could strengthen EU industrial policies to secure access to critical and strategic raw materials to reach the twin transition and the Union's strategic autonomy.
The EU already has one of the strongest chemicals legislation in the world. Further tightening would disproportionately burden businesses and jeopardise competitiveness. Instead, the focus should be on uniform and practical enforcement. We reject a move away from risk-based chemicals regulation.

The problems of global overcapacity and unfair trade practices, which are described in the Commission's call for evidence and the statement by the Wirtschaftsvereinigung Stahl, affect both the steel and the non-ferrous metals sectors. Global overcapacities severely threaten the profitability and competitiveness of European industries, including non-ferrous metals.
The Funtion of the Digital Product Passport should not be overburdend, but Focussed on key aspects following the needs of a Circular Economy. It should allow to map the urban mine and to replace existing reporting duties, to be a benefit for the Industry in Europe as the bedrock of Circular Eocnomy. Position of the WVMetalle A revision of the EU regulations on air quality is currently not necessary due the fact that there is no urgent need and more importantly it has proven to be successful. Additional-ly, the EU is already pursuing numerous legislative targets with a focus on air quality. Furthermore, there is no sufficient trade-off between health protection and other EU objectives.
