Although the principle is understandable, it remains unclear which participation is actually considered problematic and what are the objective criteria for assessing whether there is a potential distortion of competition.

* The current Article 72 of Directive 2014/24 remains too rigid and unclear, which complicates its practical implementation and leads to legal uncertainty. A provision which makes it possible to lay down the grounds for amendments in a contract is particularly problematic, but requires them to be clear, precise and unambiguous.

* The definition of innovation in Article 2(22) of Directive 2014/24 as it stands is too broad and can be interpreted in a way that also makes it possible to consider as innovation materially insignificant changes, such as the mere purchase of an existing product or service in a different way. This could lead to procurement being mistakenly referred to as innovation procurement without real novelty or added value.
