The German Bar Association (DAV) welcomes the revision of the EU Public Procurement Directives and, in this context, advocates a simplification of public procurement law as well as a strengthening of the procurement autonomy of contracting authorities. Furthermore, the DAV supports the introduction of a standardised access system to digital procurement platforms.

From the point of view of the German Bar Association, the primary objective of reforming the European public procurement directives should be to simplify and reduce red tape in public procurement law for both contracting authorities and tenderers. Public procurement law is widely regarded as a barrier and brake on necessary investment in infrastructure and modernisation.

The DAV sees a practical need for a uniform legal form across Europe to facilitate the cross-border establishment and operation of companies and to strengthen the European internal market. Please find enclosed the opinion of the German Lawyers’ Association (DAV) by the Intellectual Property Committee on the Commission’s impact assessment on compulsory licensing in the EU. The DAV welcomed in principle an evaluation of the compulsory licensing system for patents. However, the DAV is critical of the creation of a uniform system of compulsory licensing in the EU.

In its Position Paper the German Bar Association welcomes the objective to allow EU public limited liability companies to create multiple-vote shares in order to promote access to the capital market. However, the DAV demands for the extension of the scope of the draft directive to all public limited companies (and Partnerships limited by shares, KGaA).
