Fertilizers Europe takes security related potential threats of chemicals misuses very seriously and did welcome EU 2019/1148 Regulation. The above is also reflected in security being an integral part of Fertilizers Europe Product Stewardship program, that is mandatorily adopted by its members.

We see considerable difficulties with the implementation in Germany in the event that high-risk chemicals are included in Regulation (EU) 2019/1148, since there are different responsibilities in Germany at both federal and state level involved.

Regulation (EU) 2019/118, in its current wording, offers the possibility of choosing between two schemes and thus allows each EU country to adopt rules adapted not only to its specific needs but also to its specific physical, demographic, economic, agricultural and industrial characteristics. France, like the majority of the Member States of the European Union, has opted for registration.

The objective of Regulation (EU) 2019/1148 is to limit the access of members of the general public to explosives precursors. The aim is to prevent criminal actors from acquiring these substances in order to produce explosives and to use them for attacks. The VCI supports the Commission’s objective of countering and minimising the threat of terrorist attacks involving chemicals.

As the representative body for the Danish trade in fertilizers for agricultural purposes, DAKOFO fully understands and supports the objectives of EU Regulation 2019/1148, particularly the need to prevent the misuse of certain chemicals. However, we have significant concerns regarding the substantial administrative burdens that this regulation imposes on both farmers and trading companies.

We assesses the need to update the rules for the marketing and use of explosive precursors as an essential step in increasing security and public safety. The regulation plays a very important role in preventing the misuse of these substances for the illicit manufacture of explosives.
While, as economic operators, we understand and share the objectives of the explosive precursors regulations, in particular the importance to avoid the misuse of certain chemicals, the regulation imposes an admin workload that is difficult to justify on the sales between economic operators.
The aim of this contribution is to shed light on the French civil and defence pyrotechnic industry, represented by its Syndicat des Manufacturers DExplosives, de Pyrotechnie et dartifices (SFEPA www.sfepa.com).
