CineRegio continues to advocate for the continued exclusion of audiovisual services from Regulation (EU) 2018/302 (the Geo-blocking Regulation) which was adopted in February 2018 to ensure better access conditions to goods and services for individuals and businesses.

Tyrol is committed to adapting the Geo-blocking Regulation in order to enable the so-called Einheimischertariff. The Geo-blocking Regulation, adopted in February 2018, aimed to ensure better conditions of access to goods and services for individuals and businesses, especially in the area of e-commerce.

The Czech Republic welcomed the adoption of the Geo-blocking Regulation in 2018, believing that this piece of legislation would provide a clear framework for the application of the prohibition of discrimination in cross-border situations by introducing the principle of "shop like a local".

The advertising market is local and the content acquisition market is local, and defined by acquiring content rights for a broadcasting certain territory, i.e. country. Geo blocking is ion benefit for a rich and versatile local content offering.

According to Cartoon Italia, the Italian association of Italian animation producers, the banning to the use of geo-blocking in the audiovisual field would damage considerably the creative and economic sustainability of the European film and audiovisual industry. Geo-blocking is not about limiting access to content based on location, it is an essential tool for financing European films and series.

Geo-blocking plays a vital role in securing that there actually is original high quality audiovisual content in Europe and that European content is available to all EU citizens. Territorial exclusivity is especially important, basically a lifeline, for smaller territories and language areas. Geo-blocking is very much needed in order to have European AV-productions in all of our EU languages.

EU co-legislators specifically excluded film/AV services from the scope of the Regulation and the reasons for this exclusion remain valid today.

Without this system, the territoriality principle, which builds the entire value chain from film production to commercialisation, would disappear. It serves as a basic safeguard mechanism to ensure a stable and functioning film industry.

The EU Geo-blocking Regulation was designed to foster fairness in the digital single market. However, it discriminates against linguistic and cultural minorities and residents of border regions by restricting access to digital content. The regulation does not ensure multilingual access to services. Many minority groups rely on media from their kin-state due to insufficient local media support.

Canal + believes that if the European Commission were to revise the 2018 Geoblocking Regulation to include content in its scope, it would have severe consequences for the financing, distribution, and diversity of European productions. Territorial exclusivity is a cornerstone of content pre-financing, permitting producers to secure investments through exclusive licensing agreements across different markets.

AV services are excluded from the scope of the Regulation as the end of Geoblocking would drastically alter key principles on which the film sector relies to cater to different audiences, to offer a diversity of content and to contribute to the economy. In the film sector, exclusive territorial licences are standard.
