Evaluation of ACER and of the ACER Regulation

Statkraft welcomes the opportunity to contribute to the consultation on the performance of the Agency for the Cooperation of Energy Regulators (ACER). This response focuses exclusively on data collection and reporting obligations linked to ACERs market monitoring role.

Environmental Defense Fund Europe (EDFE) welcomes the European Commissions initiative to evaluate the performance of the European Union Agency for the Cooperation of Energy Regulators (ACER) and the opportunity to provide feedback to this process. EDFE considers ACER to be structurally well placed to support certain market-facing and cross-border dimensions of the implementation of the EU Methane Regulation (EUMR).

We highly appreciate the Commissions efforts to assess ACERs performance with regard to its objectives, mandate and tasks.

Nord Pool, as a Nominated Electricity Market Operator (NEMO) and a Power Exchange has cooperated closely with ACER since its creation. Nord Pool AS is also authorised as Registered Reporting Mechanism RMM and Inside Information Platform IIP under REMIT by ACER. Our main relationships with ACER focus on the Single Day Ahead and Single Intraday Electricity markets, REMIT and forward markets.

Enedis welcomes the European Commissions evaluation of ACERs performance. ACER plays an important role in supporting an integrated and well-functioning European energy market, by providing expertise and data analysis, fostering coordination between national regulators and offering a forum for dialogue on EU energy legislation.

FGSZ welcomes the European Commissions consultation on the efficiency and effectiveness of ACER in delivering its mandate. ACER plays a central role in advancing integrated European electricity and gas markets and in maximising the economic value they generate for the European Union.

Enagás, the Transmission System Operator for natural gas and provisional hydrogen transmission network operator in Spain, welcomes the opportunity to share its thoughts on ACER evaluation. This contribution is provided in response to the evaluation of ACER under Article 45(1) of Regulation (EU) 2019/942. ACER plays a critical role in supporting the functioning and integration of the EU internal energy market, particularly through coordination, transparency, and market monitoring. Its expanded responsibilities under REMIT further strengthen its role in maintaining market integrity.

I am an independent evaluator and innovation expert based in Belgium, with over 20 years of experience across industrial systems, energy infrastructure, and EU innovation ecosystems. Over the past years, I have evaluated more than 200 proposals across EU-funded and cascade funding programmes, including initiatives such as AIRISE, ADT4Blue, AgriFoodTure, INCiTiS-FOOD, GUARDIANS, and StandICT.eu.

ACER needs to step up in four areas where the EU internal energy market is visibly failing. Interconnectors enforce capacity targets and stop TSOs gaming the system. Energy communities implementation is a patchwork; harmonise grid fees and name non-compliant member states. Regulator independence too many NRAs are still too close to the incumbents they regulate; ACER should publish an annual independence index.
