While Europe boasts a world-class scientific base and a wealth of talent, its potential is consistently hampered by systemic barriers: regulatory fragmentation, obstacles to long-term financing, and a systemic talent shortage. These issues affect all innovative sectors, creating a significant competitive disadvantage compared to other global powers.

The European Innovation Act is a pivotal opportunity to strengthen Europes innovation ecosystem by making it more inclusive. Gender equality and innovation excellence go hand in hand: Europe cannot reach its innovation goals if women and other underrepresented groups are left out. Statement on the European Innovation Act: Strengthening Regulated Innovation Finance and Market Uptake As a long-standing supplier and buyer in EU-funded research, innovation, and procurement programmes with direct experience across more than 20 EU grants and tenders (including with the EC, EIB, and EUIPO) we welcome the ambition of the European Innovation Act (EIA) to unlock Europes innovation potential.

We welcome the EIA as a vital step to boost Europe's competitiveness and strengthen its innovation ecosystems. While the EIA's focus on deep tech and regulatory streamlining is commendable, its success hinges on addressing persistent challenges: The low commercialisation of excellent research, the access to funding for startups, and difficulties in attracting and retaining talent.

We warmly welcome the initiative of the European Commission to prepare the European Innovation Act (EIA) as a key instrument for implementing the EU Startup and Scaleup Strategy and delivering on the objectives of the Competitiveness Compass.

Startups and scaleups in the EU face persistent difficulties in leveraging their intellectual property rights (IPRs) as collateral to access financing from financial institutions and private investors. This limitation not only restricts their capacity to scale innovation but also undermines their ability to manage and enforce their IPRs effectively.

Location Innovation Hub (LIH), a European Digital Innovation Hub specialising in location intelligence, geospatial AI, and digital twin technologies, welcomes the European Commissions initiative for a European Innovation Act.

CEPES (Spanish Confederation of Social Economy Enterprises) is the leading representative organisation for Spanish Social Economy Enterprises. In Spain, the Social Economy plays a significant socio-economic role, encompassing over 74,600 enterprises and entities that generate 10% of the national GDP and provide employment to 2.5 million people (CEPES, 2024).

The lack of harmonised definition of an innovative company in the EU, nor of what constitutes a start-up or a scale-up hinders the implementation of appropriate and effective policies for these companies. It also leads entrepreneurs to adopt company statutes that are unsuited to their particular situation, resulting in costly administrative and regulatory burdens.

The Allwaters consortium offers the following recommendations: 1. Simplification must be a guiding principle of the Innovation Act. Complex rules and fragmented policies across Member States create unnecessary burdens for innovators. The Act should streamline procedures, reduce administrative overhead and provide clear, consistent guidance across the Single Market.

Article 72 of the Directive should contain a specific provision allowing the allocation of intellectual property rights to be modified during contract performance without being regarded as an unlawful modification or an undue advantage. The objective of contracting authorities is not to accumulate intellectual property that they do not require.

The notion of intellectual property is very broad and, if used without clarification, can create significant uncertainty in practice. Regulation should explicitly define whether, and in which circumstances, reference is made to copyright (for example software, databases or documents), inventions and patentable solutions, utility models, design rights, trademarks, trade names or confidential know-how.

Europes innovation ecosystem faces lack of capital, fragmentation, insufficient coordination, and regulatory complexity. For life sciences, these elements limit competitiveness and discourage investment. At the same time, Europe is losing global market share in R&D, clinical trials, and biomanufacturing, while talent continues to move abroad.

Today's most disruptive innovations emerge from combining vast amounts of data from various sources. It is safe to say that data is the most valuable raw material of innovation. The European Innovation Act must prioritise creating optimal conditions for finding and using data for innovation purposes.

We are all very pleased of the new and fertile scenario set by the Commission for startups and scaleups. Nevertheless, there is still a critical issue, which jeopardizes this remarkable effort by the Commission and sets strong barriers to the investments of Funds in SMEs and to the access to public finance by the SMEs.

The future European Innovation Act represents a strategic opportunity to strengthen the competitiveness of the European innovation ecosystem, provided that effective regulatory coherence between levels of governance is ensured and the role of large public operators is recognised as catalysts for innovation.

Often minimum requirements to participate in Tenders are way too high for SMEs. Companies shouldn't need existing revenue of over 100K ARR to apply to some of these tenders. There are a lot of tenders that seem to be tailored to one specific company with really specific requirements and references for an industry that add barriers of entry. Europe should prioritize competition of free markets over prior experience.
