IRDG Submission to the European Innovation Act The Industry Research & Development Group (IRDG), representing Irelands industry-led innovation ecosystem, strongly supports the European Commissions proposed European Innovation Act (EIA) as a timely and vital framework to strengthen innovation across the EU.

The Norwegian University of Science and Technology (NTNU) highly values the opportunity to contribute to this consultation on such a crucial topic for Europes future. With a main profile in technology and natural sciences, NTNU considers this process particularly important for strengthening Europes innovation capacity, competitiveness, and sustainability.

CIRAD is a French research performing organisation in agriculture, working in cooperation with tropical and Mediterranean countries. Innovations resulting from this collaborative research have sometimes been licensed to EU and/or non-EU SMEs. On other occasions, innovations have been directly spinned off for an access to the market.

We submit this feedback as a team of researchers working on Atlantic Futures a university research project led by Ulster University, University of Galway, and University of Limerick, funded by the North South Research Programme. Based in Ireland and Northern Ireland, our team has been conducting research on scaling organisations in peripheral regions within Ireland for the past two years.

BDVA welcomes the European Commissions efforts to improve the European innovation ecosystem through the European Innovation Act. Addressing the innovation in Europe to boost the competitiveness and foster growth is a key challenge from BDVAs perspective.

Personally, and from the perspective of a TTO manager, I would like to stress a few priorities for strengthening the research-to-market pipeline in Europe. The European Union must urgently overcome its innovation gap. While Europe boasts a world-class scientific base and a wealth of talent, its potential is consistently hampered by systemic barriers: regulatory fragmentation, obstacles to long-term financing, and a systemic talent shortage. These issues affect all innovative sectors, creating a significant competitive disadvantage compared to other global powers.

The European Innovation Act is a pivotal opportunity to strengthen Europes innovation ecosystem by making it more inclusive. Gender equality and innovation excellence go hand in hand: Europe cannot reach its innovation goals if women and other underrepresented groups are left out. Integrating gender equality across the Act will promote fairness while enhancing creativity, market relevance, and competitiveness.

Research and Innovation are strongly interlinked. The Innovation Act should enable the effective valorisation of research into innovation, with excellence as a key criterion for research assessment. The European Alliance for SSH has a long experience in studies and research on innovation in the service sector and social innovation which is critical for resilience and development, especially during difficult times. Startups and scaleups in the EU face persistent difficulties in leveraging their intellectual property rights (IPRs) as collateral to access financing from financial institutions and private investors. This limitation not only restricts their capacity to scale innovation but also undermines their ability to manage and enforce their IPRs effectively.

CEPES (Spanish Confederation of Social Economy Enterprises) is the leading representative organisation for Spanish Social Economy Enterprises. In Spain, the Social Economy plays a significant socio-economic role, encompassing over 74,600 enterprises and entities that generate 10% of the national GDP and provide employment to 2.5 million people (CEPES, 2024).

The lack of harmonised definition of an innovative company in the EU, nor of what constitutes a start-up or a scale-up hinders the implementation of appropriate and effective policies for these companies. The Allwaters consortium offers the following recommendations: 1. Simplification must be a guiding principle of the Innovation Act. Complex rules and fragmented policies across Member States create unnecessary burdens for innovators. The Act should streamline procedures, reduce administrative overhead and provide clear, consistent guidance across the Single Market.

Article 72 of the Directive should contain a specific provision allowing the allocation of intellectual property rights to be modified during contract performance without being regarded as an unlawful modification or an undue advantage. The objective of contracting authorities is not to accumulate intellectual property that they do not require.

The notion of intellectual property is very broad and, if used without clarification, can create significant uncertainty in practice. Regulation should explicitly define whether, and in which circumstances, reference is made to copyright (for example software, databases or documents), inventions and patentable solutions, utility models, design rights, trademarks, trade names or confidential know-how.

Europes innovation ecosystem faces lack of capital, fragmentation, insufficient coordination, and regulatory complexity. For life sciences, these elements limit competitiveness and discourage investment. At the same time, Europe is losing global market share in R&D, clinical trials, and biomanufacturing, while talent continues to move abroad.

Often minimum requirements to participate in Tenders are way too high for SMEs. Companies shouldn't need existing revenue of over 100K ARR to apply to some of these tenders. There are a lot of tenders that seem to be tailored to one specific company with really specific requirements and references for an industry that add barriers of entry. Europe should prioritize competition of free markets over prior experience.
